1. Introduction and Acceptance of Terms
These Terms of Service ("Terms") govern your access to and use of the services, website, communications, bookings, and related offerings provided by Harbour Peak Hiking Co. ("we", "us", or "our"). By making a booking, participating in any tour or activity, or otherwise using our services, you acknowledge that you have read, understood, and agree to be bound by these Terms.
If you do not agree to these Terms, you must not use our services or make any booking. If you are booking or participating on behalf of another person, you represent and warrant that you have authority to accept these Terms on their behalf and that you will ensure they comply with them.
These Terms are intended to be interpreted in accordance with the laws of the Hong Kong Special Administrative Region ("Hong Kong"). Nothing in these Terms excludes or limits any rights or remedies that cannot lawfully be excluded under applicable Hong Kong law.
2. Scope of Services
We provide hiking and outdoor experience services, which may include, without limitation:
- Guided day hikes;
- Private hiking tours;
- Sunrise and sunset trail experiences;
- Corporate team-building hikes;
- Family-friendly nature walks; and
- Custom trail planning and route consultation.
The exact nature, duration, route, difficulty, meeting point, inclusions, exclusions, and any special requirements for each service will be described in the relevant booking confirmation, itinerary, proposal, or service description.
We may modify routes, schedules, or activity plans at any time where necessary for safety, weather, trail closures, government restrictions, environmental protection, or other operational reasons.
3. User Obligations and Responsibilities
By participating in our services, you agree to the following obligations:
- You will provide accurate, complete, and up-to-date information when booking or communicating with us.
- You will disclose any relevant medical conditions, injuries, allergies, mobility limitations, pregnancy, or other circumstances that may affect your ability to participate safely.
- You will ensure that you are physically and mentally fit to participate in the selected activity.
- You will follow all instructions given by our guides, staff, or representatives at all times.
- You will wear appropriate clothing, footwear, and carry any recommended equipment, water, food, medication, and personal items.
- You will comply with all applicable laws, trail rules, park regulations, and government requirements.
- You will not engage in reckless, unlawful, abusive, disruptive, or unsafe conduct.
- You will not bring prohibited items, including illegal substances, weapons, or any item that may endanger others.
- You will supervise minors under your care at all times and accept full responsibility for their conduct and safety.
- You will respect the environment, wildlife, local communities, and other trail users, including by following leave-no-trace principles.
We reserve the right to refuse participation, remove any participant from an activity, or cancel a booking without refund if, in our reasonable opinion, a participant poses a safety risk, is unfit to participate, is under the influence of alcohol or drugs, or fails to comply with these Terms or our instructions.
You acknowledge that hiking and outdoor activities involve inherent risks, including uneven terrain, slips, falls, weather changes, heat stress, dehydration, fatigue, wildlife encounters, and other hazards. You voluntarily assume these risks to the fullest extent permitted by law.
4. Payment Terms and Conditions
Fees, deposits, and payment deadlines will be communicated at the time of booking or in the relevant quotation or invoice. Unless otherwise stated, all prices are quoted in Hong Kong dollars (HKD).
- Bookings may require full payment or a non-refundable deposit to secure the reservation.
- Payment must be made using the methods we accept from time to time.
- Any bank charges, foreign exchange fees, card processing fees, or intermediary charges are your responsibility unless we state otherwise.
- If payment is not received by the due date, we may suspend, cancel, or refuse the booking.
- We reserve the right to adjust prices at any time before booking confirmation.
For corporate, private, or custom services, additional charges may apply for special arrangements, extended duration, transport, permits, equipment, meals, or other third-party costs. Any such charges will be disclosed where reasonably practicable before confirmation.
Unless expressly stated otherwise, all fees are exclusive of any taxes, duties, or governmental charges that may apply.
5. Cancellation and Refund Policy
Cancellations and refunds are subject to the specific terms stated in your booking confirmation. If no specific terms are stated, the following default policy applies:
- Cancellations made more than 14 days before the scheduled activity: full refund, less any non-refundable deposit or third-party costs already incurred.
- Cancellations made 7 to 14 days before the scheduled activity: 50% refund, less any non-refundable deposit or third-party costs already incurred.
- Cancellations made less than 7 days before the scheduled activity: no refund.
- No-shows, late arrivals, or early departures: no refund.
We may, at our discretion, offer rescheduling instead of a refund, subject to availability and any additional costs.
If we cancel an activity due to unsafe weather, trail closure, government restrictions, insufficient participants, or other operational reasons, we may offer one of the following remedies at our discretion:
- Rescheduling to an alternative date;
- A credit for future use; or
- A refund of the amount paid for the cancelled activity, excluding any non-refundable third-party costs already incurred where permitted by law.
We are not responsible for any costs you incur in connection with a cancellation, including transport, accommodation, insurance, or personal expenses, unless required by applicable law.
Any refund will be processed using the original payment method where practicable and within a reasonable time after approval.
6. Liability Limitations
To the maximum extent permitted by Hong Kong law, we exclude all warranties, representations, and conditions not expressly stated in these Terms.
Nothing in these Terms shall exclude or limit our liability for:
- Death or personal injury caused by our negligence;
- Fraud or fraudulent misrepresentation;
- Any liability that cannot be excluded or limited under applicable law.
Subject to the foregoing, we shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive losses, including loss of profits, loss of enjoyment, loss of opportunity, loss of data, or business interruption.
To the fullest extent permitted by law, our total aggregate liability arising out of or in connection with any booking, service, or these Terms shall be limited to the amount paid by you for the specific service giving rise to the claim.
We are not responsible for losses or damages arising from:
- Your failure to follow instructions or comply with these Terms;
- Your failure to disclose relevant medical or fitness information;
- Acts or omissions of third parties, including transport providers, venue operators, or other participants;
- Weather conditions, natural events, trail conditions, or wildlife encounters;
- Loss, theft, or damage to personal belongings;
- Any delay, cancellation, or alteration caused by circumstances beyond our reasonable control.
You are strongly advised to obtain appropriate travel, accident, and personal effects insurance covering participation in outdoor activities.
7. Intellectual Property Rights
All content, materials, branding, logos, photographs, videos, route plans, written materials, itineraries, and other intellectual property made available by us are owned by or licensed to Harbour Peak Hiking Co. and are protected by applicable intellectual property laws.
You may not copy, reproduce, distribute, modify, publish, transmit, display, create derivative works from, or otherwise use our intellectual property without our prior written consent, except as permitted by law.
Any feedback, suggestions, or ideas you provide to us may be used by us without restriction or compensation, unless otherwise agreed in writing.
If you share photographs, videos, testimonials, or other content with us, you grant us a non-exclusive, worldwide, royalty-free, perpetual licence to use, reproduce, modify, publish, and display such content for business, marketing, and promotional purposes, subject to applicable law and any written restrictions you notify us of in advance.
8. Data Protection and Privacy
We collect, use, store, and process personal data in connection with bookings, communications, safety management, service delivery, payment processing, and marketing, where permitted by law.
We will handle personal data in accordance with the Personal Data (Privacy) Ordinance (Cap. 486) of Hong Kong and our applicable privacy practices.
Personal data may include, without limitation:
- Contact details;
- Identification information;
- Emergency contact details;
- Medical or fitness information relevant to safety;
- Payment and billing information;
- Booking history and service preferences;
- Photographs, videos, or other content collected during activities, where applicable.
We may disclose personal data to our employees, guides, contractors, payment processors, insurers, legal advisers, and relevant authorities where necessary for service delivery, safety, compliance, or lawful requests.
Where we use personal data for direct marketing, we will do so only in accordance with applicable law and any consent or opt-out preferences you have provided.
You have rights in relation to your personal data under Hong Kong law, including the right to request access to and correction of your personal data, subject to applicable legal exceptions. Requests may be made using the contact details below.
9. Force Majeure
We shall not be liable for any failure or delay in performing our obligations where such failure or delay results from events beyond our reasonable control, including but not limited to:
- Severe weather, typhoons, heavy rain, landslides, flooding, or extreme heat;
- Natural disasters, fire, epidemic, pandemic, or public health emergency;
- Government action, legal restrictions, trail closures, or public safety orders;
- Transport disruption, strikes, labour disputes, or utility failures;
- War, civil unrest, terrorism, or other emergency events;
- Any similar event beyond our reasonable control.
In such circumstances, we may modify, postpone, or cancel services without liability except as expressly required by applicable law or as otherwise stated in these Terms.
10. Changes to Terms
We may update or revise these Terms from time to time to reflect changes in our services, operational practices, or legal requirements. The updated Terms will take effect from the date stated on the revised version, unless otherwise specified.
Your continued use of our services after any change constitutes acceptance of the revised Terms. We encourage you to review these Terms periodically.
11. Applicable Law and Jurisdiction
These Terms and any dispute or claim arising out of or in connection with them, including any non-contractual disputes or claims, shall be governed by and construed in accordance with the laws of Hong Kong.
You agree that the courts of Hong Kong shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms, subject to any mandatory rights you may have under applicable law.

13. Severability Clause
If any provision of these Terms is held to be invalid, illegal, or unenforceable by a court or competent authority, that provision shall be deemed modified to the minimum extent necessary to make it valid, legal, and enforceable, or if such modification is not possible, it shall be severed from these Terms.
The remaining provisions shall continue in full force and effect to the fullest extent permitted by law.
Entire Agreement: These Terms, together with any booking confirmation, itinerary, quotation, waiver, or additional written agreement issued by us, constitute the entire agreement between you and us regarding the relevant services and supersede any prior understandings or representations to the extent permitted by law.
